Definitions

BIC "HARPER MEDKLINIK" SRL - as a legal entity under private law (limited liability company), c.f. 1008600047978, with legal headquarters located in the Republic of Moldova, Chisinau municipality, 10B Calea Ieșilor Street, registered at the Public Services Agency, hereinafter the Company.

Buyer - natural person over 18 years old/legal person or any legal entity that creates an Account on the Site and places an order.

Client – ​​natural person/legal person who has or obtains access to the website www.harper.md from any communication device: phone, tablet, PC, Laptop, etc.

User – any natural/legal person registered on the site, who, by completing the Account creation process.

Account – A section of the Site consisting of an email address and a password that allows the Buyer to submit the Order and that contains information about the Customer/Buyer and the history of the Buyer on the Site (these can be, but are not expressly limited to Orders, guarantees , shopping lists, etc.).

Order – An electronic document through which the Client requests the Provider (Company), through the Site, the intention to benefit from the services provided on the site and through which a form of communication between the parties is allowed.

Service – Any service, including the documents and services mentioned in the Order, to be provided by the Company to the Beneficiary (Client) as a result of the concluded electronic Contract.

Contract – A contract concluded at a distance between the Provider and the Beneficiary.

Content – ​​Information that can be viewed or accessed through the use of electronic equipment.

Review – An evaluation written by the beneficiary of a service, based on personal experience, about a particular service.

Comment – ​​An appreciation or observation with a critical purpose on a service or other comment.

Transaction – Collection of an amount resulting from the provision of a service by the company to the Beneficiary, regardless of the method of request.

Intellectual Property Rights and Content

The website www.harper.md is the property of the Company. The site is intended for the provision of services through the www.harper.md platform. The content of www.harper.md, including but not limited to logos, stylized representations, commercial symbols, static images, dynamic images, text and/or multimedia content presented on the Site, are the exclusive property of the Company, its all rights conferred by law directly or indirectly (through licenses for use and/or publication) being reserved.

The Beneficiary is not permitted to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, include any content in any context other than the one originally intended by the Company, include any content outside the Site , removing the signs signifying the Company's copyright on the content as well as participating in the transfer, sale, distribution of materials made by reproducing, modifying or displaying the content, except with the express written consent of the Company. Any content to which the Beneficiary has and/or obtains access by any means, is subject to the General Conditions, if the Content is not accompanied by a specific and valid User Agreement concluded between the Company and it, and without any implied guarantee or expressly formulated by the Company with reference to that content. The Buyer may not copy, transfer and/or use the content under any circumstances without the Company's prior consent.

If the Company gives the Beneficiary the right to use, in the form described in a separate user agreement, certain content, to which the Buyer has or obtains access following this Agreement, this right refers only to those contents defined in the Agreement, only for the period of its existence or these contents on the Site or the period defined in the Agreement, according to the defined conditions, if they exist and do not represent a contractual commitment on the part of the Company for the respective Beneficiary or any other third party who has/obtains access to this content transferred, by any means, and which may be or is harmed in any way by such content, during or after the expiration of the user agreement.

No Content transmitted to the Beneficiary, by any means of communication (electronic, telephone, etc.) or acquired by him by accessing, visiting and/or viewing does not constitute an obligation on the part of the Company and/or the employee/contractor who mediated the transfer of Content , if any, against that content. Any use of the Content for purposes other than those expressly permitted by these Terms and Conditions or the accompanying user agreement, if any, is prohibited.

Disclaimer

The Company does not warrant that the Site, the servers on which it is hosted or e-mails sent from the Company are free of viruses or other potentially harmful computer components, that they are free of omissions, defects, delays or interruptions in operation or transmission, line failures or other similar factors.

 Registering as a user

The customer has the option to create an account on www.harper.md, by providing: Personal account login; Personal account password; Account creation unique password; IDNP; E-mail; Mobile phone; Telephone/fax number; Electronic signature (mobile, electronic signature, electronic bulletin, 2-step authentication) MPass, facebook or google account;

The customer is solely responsible for the use of the password, which is strictly confidential. Validation of the user account will be done by sending a validation code via SMS. This code is entered into the site by validating and using the current account.

Privacy policy

The Company will exercise maximum diligence so that no confidential information with/about/and in connection with any account opened on www.harper.md remains confidential. The information submitted will be treated as confidential information and must be used only for the purpose for which it was submitted and must not be used for any other purpose without your written consent, unless:

a) were known by the party that received the information, before being brought to their attention by the party disclosing the information through a public channel, thus becoming public information;

or

b) required to be disclosed by the applicable law, court decision or competent authorities.

The services offered

Services – Medical services and other similar services. The list and characteristics of the services present on the website www.harper.md are susceptible to being modified and adapted at any time in order to respond as best as possible to customer requests and the legislation in force. The services presented on www.harper.md comply with national legislation and are intended for end users, especially consumers who have reached the age of 18 and not for the purpose of resale.

The service sheet can be found on the page dedicated to services on the website www.harper.md. It contains useful and detailed information about the services on www.harper.md. The information contains the name of the package, the price of the package, the characteristics of the package. The package information sheet has a strictly informative title, in order to obtain the most correct and complete information, consult the information on the website and/or, as the case may be, contact the manufacturer.

The services are available at the proposed prices and conditions, as displayed on the website www.harper.md. The company undertakes to provide the customer with any other additional information necessary for the successful completion of his order. In the exceptional event that the information regarding the availability of the services is incorrect, the Company undertakes to inform the customer of these aspects by e-mail or by telephone.

Price

The prices of the services displayed on the website www.harper.md are the official ones and are expressed in Lei/Euro, include VAT. and all related taxes, according to the legislation in force. The prices are applicable at the moment of validation of the order by the customer, at the NBM exchange rate on the day of payment. Payment will be made in Moldovan lei.

If the price of the service or some of its features have been wrongly displayed on www.harper.md, we reserve the right to cancel the provision of the service and notify the client as soon as possible about this situation. Payment terms - Online via bank cards, MPAY

Online order

To place an online order, the customer has 2 possibilities:

1. To request the service, fill in the following data: Name, Surname, E-mail, Telephone, City, Payment method and make the online payment for the service request; or

2. to create an account (personal account), which will be authenticated with login, password and/or Electronic signature (mobile, electronic signature, electronic bulletin, 2-step authentication) MPass. If you are a new customer, you will fill in your data and press the registration button. From the displayed menu, the customer can access the service category and choose the desired service. On the service page you can view its price and availability.

The Company may cancel the Order made by the Beneficiary, following a prior notification addressed to the Beneficiary, without any further obligation of either party to the other or without any party being able to claim damages from the other in the following cases:

a) non-acceptance by the issuing bank of the Beneficiary's card, of the transaction, in the case of payment by electronic card;

b) invalidation of the transaction by the card processor approved by the Company, in the case of payment by bank card;

c) the data provided by the Client/Beneficiary on the Site are incomplete and/or incorrect;

In all the situations presented above, the Beneficiary will be informed by e-mail about the replacement or cancellation changes.

Payment and provision of services:

Payment can be made with a debit or credit bank card;

There is no upper or lower value limit for the orders that can be placed through the Website. The company does not ask its customers via e-mail, text messages, phone calls or any other means of communication, information about bank accounts, passwords or data associated with debit or credit cards. This information is strictly confidential. The Beneficiary is responsible for maintaining the confidentiality of his Account data, password and banking data used to make payments for services. The information entered in order to make a payment with the card (card number, password, card validity date) are not collected, stored and processed by the Company, but will be processed exclusively by the financial banking units issuing the cards. The services on this website are marketed through online payment solutions provided by the payment processor. All banking transactions on www.harper.md will be carried out in a secure manner, the payment processor being the guarantor of the protection of all data and personal information related to payment methods. The tax receipt and/or the tax invoice will be issued upon request for each individual order and will accompany the services provided and/or will be sent in electronic format.

The services included in the subscriptions made available by the company will be provided from the moment of making the payments according to the subscription package requested by the Client/Beneficiary, the provision of the services being irreversible, for which reason the return of payments for the company's services that have been provided will not be made or are to be provided according to the subscription packages that the Clients/Beneficiaries have benefited from/will benefit from.

Terms and conditions for returning services / money - in the case of valid reasons for canceling the appointment, at least 60 minutes after the appointment for the provision/delivery of the consultation, the payer has the right to cancel the appointment and request the return of the money paid in advance . For this purpose, the payer will send a request in free form to the address info@harper.md where he will indicate the dates of the transfer / appointment, attach the copy of the identity card (ID Card) and the bank details (complete) to which the money will be returned. The request will be processed, and the money will be returned in a maximum of 14 working days.

Fraud

The company will at all times take all the measures provided by the Law in order to report to the competent authorities about possible fraudulent actions, including those of money laundering.

Limit of liability

The company can modify the Terms and Conditions of the website www.harper.md at any time, with the new provisions becoming public and binding on customers from the date they are uploaded to the website.
